Privacy Notice

This is an English courtesy translation. The legally binding version is the Spanish notice published at bitfx.mx/aviso-de-privacidad, issued under Mexico's Federal Law on the Protection of Personal Data Held by Private Parties.

1. Identity and address of the data controller

BITFX INFORMATION TECHNOLOGY S DE RL DE CV ("BITFX") is responsible for the processing of the personal data you provide through the website bitfx.mx and its associated contact channels, for the use given to it, and for its protection under applicable law. Address: Senda de la Inspiración #19, Milenio 3ra Sección, C.P. 76060, Santiago de Querétaro, Querétaro, Mexico.

2. Personal data we collect

For the purposes described in this notice we collect the following categories:

  • Identification and contact data: full name, email address, phone number, company or organization and job title, when you provide them in our contact, quote or meeting-booking forms.
  • Communication data: the content of messages, requirements or project descriptions you share with us through the site, email or WhatsApp.
  • Browsing data: IP address, browser and device type, pages visited, date and time of access, and data collected through cookies and similar technologies (see section 8).

BITFX does not collect sensitive personal data (such as health status, ethnic origin, religious beliefs, political opinions or sexual preference) through its website. Please do not send us that type of information through our forms.

3. Purposes of processing

Primary purposes (necessary for the legal relationship and service delivery):

  • Responding to your requests for information, contact or quotes regarding our software development services and SaaS products.
  • Following up commercially on the project requirements you raise and preparing proposals.
  • Formalizing, where applicable, the contractual and billing relationship arising from the services requested.
  • Ensuring the security, availability and correct operation of the website.

Secondary purposes (voluntary — require your consent):

  • Sending you communications about new services, products, content, events or promotions from BITFX.
  • Preparing statistical and market analyses to improve our services.

If you do not wish your personal data to be processed for secondary purposes, you may say so at any time by writing to [email protected]. Refusing the use of your data for secondary purposes will not be grounds for denying you the services you request.

4. Transfers and data processors

BITFX does not sell or assign your personal data to third parties. Your data may be processed by providers acting as processors on behalf of and under the instructions of BITFX (for example, hosting services, cloud infrastructure, web analytics tools and customer management platforms), which are contractually bound to protect your information. Outside these cases, we will only transfer your data where the law permits it or a competent authority requires it, in which case your consent is not required.

5. ARCO rights

You or your legal representative have the right to Access your personal data; to Rectify it when it is inaccurate or incomplete; to Cancel it when you consider it is not required for any of the stated purposes, is being used for non-consented purposes, or the contractual or service relationship has ended; and to Object to its processing for specific purposes (ARCO rights). Exercising these rights is free of charge.

To exercise them, send a request to [email protected] containing: (i) your full name and a means to communicate our response; (ii) documents proving your identity or legal representation; (iii) a clear and precise description of the data concerned; and (iv) any element that helps locate your data. We will respond within a maximum of twenty business days from receipt of the request and, where applicable, it will take effect within the following fifteen business days after our response is communicated.

6. Withdrawal of consent and limitation of use or disclosure

You may withdraw at any time the consent you have given us for the processing of your personal data, and request the limitation of its use or disclosure, through the same procedure and email address stated above. Please note that withdrawal has no retroactive effect and that in some cases we may not be able to act on it immediately if a legal or contractual obligation requires continued processing.

7. Security measures

BITFX has implemented reasonable administrative, technical and physical security measures to protect your personal data against damage, loss, alteration, destruction, or unauthorized use, access or processing, appropriate to the type of data processed and the risks identified.

8. Cookies and tracking technologies

Our site uses cookies and similar technologies for its operation, to remember your preferences and to generate usage statistics through analytics tools (Google Analytics 4). You may disable cookies from your browser settings; doing so may affect some site functions. Data obtained through these technologies is processed in aggregate form and for the purposes described in this notice.

9. Changes to this privacy notice

BITFX may modify or update this privacy notice to address legislative changes, internal policies or new service requirements. Any modification will be published at bitfx.mx/aviso-de-privacidad, stating the date of last update.

10. Competent authority

If you believe your right to the protection of personal data has been infringed, you may approach the Secretaría Anticorrupción y Buen Gobierno, the competent authority for the protection of personal data held by private parties in Mexico.
